Short answer

  • A Dubai developer cannot terminate the day after you miss an installment: it must first report the default to the Dubai Land Department (DLD), which then gives you 30 days in writing to pay.
  • After the 30 days, the developer may keep up to 25% of the unit value if the whole project is below 60% complete, and up to 40% from 60% (Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020).
  • If work never started for reasons outside the developer's control, or RERA cancelled the project, all payments must be refunded.
  • Any excess above the retained amount is due within one year of termination or 60 days of resale, whichever is earlier.

Missed off-plan payment? Dubai law does not let a developer simply keep your unit and your money. It sets a fixed sequence: a default notice served through the DLD, a 30-day window, then termination rules tied to how far the building has progressed.

This guide walks through each stage with the numbers attached, for buyers who can't pay off-plan installments on schedule. It covers Dubai rules only.

Terms used below: the SPA (Sale and Purchase Agreement) is your contract, and RERA (Real Estate Regulatory Agency) is the DLD's regulatory arm.

Missed off-plan payment: Dubai default steps, in order

A Dubai developer has to go through the DLD before it can end your contract for non-payment. The sequence below comes from Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, the version currently in force.

From a missed installment to a possible termination

Due date passes
An installment under the SPA payment plan goes unpaid
Developer files with the DLD
The developer reports the default on the DLD's form
Written notice
After checking the claim, the DLD serves a dated notice on the buyerIn person, by registered mail, by email or another approved method
30 days
Window to pay or reach a settlement; the DLD may mediate
Day 31
The DLD gives the developer a document stating the project's completion percentage
Termination
The developer may act under the tier that matches that percentage
Refund deadline
Excess over the retained amount: within 1 year of termination or 60 days of resale, whichever is earlier

Article 11 has been rewritten several times since 2008, so articles quoting older percentages may be out of date.

What does the off-plan payment default notice from the DLD mean?

The DLD notice is the formal start of the clock. Once it is served, you have thirty days to perform your obligation or agree a settlement before the developer can move to termination.

The DLD may deliver it by email, so for a buyer abroad the inbox linked to your SPA matters. Record the date the message arrived.

Inside those 30 days the DLD may mediate. If you agree new terms, such as a revised schedule, the settlement becomes a signed addendum to the SPA.

How much can the developer keep after termination?

The amount depends on the completion percentage of the whole project, measured under RERA standards, not on how much of your own unit is finished. Al Tamimi's March 2021 update confirms that the 2020 amendment moved the test to the whole project.

40%

40%

Above 80%, the developer picks one route: keep the contract and claim the balance; ask the DLD to auction the unit to recover the balance, with sale costs on the buyer; or terminate and keep up to 40% of the unit value.

Example: a unit priced at AED 1,000,000 in a project that is 50% complete. The buyer has paid AED 400,000. On termination, the developer may keep up to AED 250,000 (25%), so at least AED 150,000 comes back to the buyer, within a year or within 60 days of a resale.

The figures are ceilings, and Article 11(f) treats the rules as public order, so a step that skips the procedure is null.

Can't pay off-plan installments in Dubai? Your options before termination

The strongest options exist before day 30. Once the DLD issues its completion document, most choices move to the developer.

  1. Confirm the project's status

Look up the project in the DLD's Dubai REST app or website to see its completion percentage and status. Whether work has started, or whether RERA has cancelled the project, changes the outcome completely.
  2. Write to the developer early

Propose a realistic revised schedule and ask for the answer in writing.
  3. Use the DLD mediation window

Once a notice arrives, ask about DLD mediation before day 30.
  4. Consider a resale

The law allows a registered off-plan unit to be sold before handover, but the DLD FAQ says assignment needs the developer's No Objection Certificate (NOC). Many SPAs require 30–40% to be paid first.
  5. Take legal advice on a dispute

Article 11(g) keeps your right to go to court or, if the SPA provides for it, to arbitration.

A resale depends on the developer's NOC terms. Our guide to selling off-plan before handover covers thresholds and fees, and every way to cancel an off-plan contract compares the exits side by side.

Lost job: off-plan payments in Dubai still fall due

No rule in Dubai's off-plan legislation, as reviewed for this guide, pauses an SPA payment plan because a buyer loses a job. The contract schedule and the Article 11 process apply as written unless the developer agrees otherwise.

…ask for a refund of the amount I have already paid?
a buyer who lost his job, writing to Gulf News' Ask the Law · Gulf News, Apr 2022

A buyer who contacts the developer before the DLD notice has more room, because the 30-day clock has not started.

Should you stop paying if construction looks stalled?

Withholding an installment on purpose can still lead to a default notice. Check the official facts first and speak to a UAE-qualified lawyer before deciding.

The DLD FAQ says payments follow completion rates, and that an investor can ask for a letter from the DLD-approved project consultant confirming the current percentage before paying. Payment plans themselves are set by your SPA, so compare the two. Our pre-payment progress check explains how.

For the full legal text of the retention tiers, read the 25% and 40% termination rules. Before agreeing any revised schedule, look up the project's public record so the addendum matches the facts.

What is the off-plan payment default notice from the DLD?
The off-plan payment default notice is a written, dated notice the Dubai Land Department serves on a buyer after a developer reports a missed payment and the DLD verifies it. The notice gives the buyer 30 days to pay or settle. It can be delivered in person, by registered mail, by email or by another approved method.
Can a Dubai developer keep all my money if I miss a payment?
A Dubai developer cannot simply keep everything after one missed payment. Under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, retention on termination is capped at 25% of the unit value below 60% project completion and 40% from 60%. Above 80%, the developer may instead hold the buyer to the contract.
I lost my job. Can I pause my off-plan payments in Dubai?
A lost job does not, by itself, pause off-plan payments in Dubai under the legislation reviewed here. The SPA schedule still applies unless the developer agrees a change. Contacting the developer before any DLD notice, and using DLD mediation if a notice arrives, are the usual routes to a revised plan recorded as an SPA addendum.
What if construction never started on my project?
If construction on a Dubai off-plan project never started for reasons beyond the developer's control, or RERA cancelled the project by a final reasoned decision, Article 11 as amended in 2020 requires the developer to refund all payments made. The older rule allowing a 30% deduction in these cases no longer applies.
