Short answer

  • Missed off-plan payment, Dubai, UK buyers: you are not cut off at once. the developer must notify the Dubai Land Department, which then gives the buyer 30 days to pay or settle.
  • The DLD may mediate during those 30 days, and any settlement is signed as an addendum to the SPA.
  • If nothing is resolved, the developer may terminate and keep up to 25% or 40% of the unit value, depending on the whole project's completion (Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020).
  • Options before termination include a revised payment plan, a resale with the developer's NOC, or paying the arrears.

Missed off-plan payment, Dubai, UK buyers: what happens next?

A formal process starts, not an instant forfeit. Under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, the developer reports the default to the Dubai Land Department (DLD) on the DLD's form, and the DLD verifies it before acting.

From missed instalment to possible termination

Missed instalment
Developer notifies the DLD of the default on the DLD form
DLD verifies
Written, dated notice served on you: 30 days to pay
During the 30 days
DLD may mediate; any deal is signed as an SPA addendum
Day 30, no deal
DLD issues the developer a document stating the project's completion percentage
Then
Developer may act under the Article 11 tier for that percentage
…otherwise, it will forfeit the apartment and the money.

The notice can arrive in person, by registered mail or by email. From the UK, email is likeliest to reach you, so keep your address current.

Can't pay off-plan instalments (Dubai) from the UK: what are my options?

Act before the 30 days run out, while you still have choices. Each option below keeps the contract alive or ends it on terms you negotiate.

Options to raise during the 30-day window

Resale has conditions set by the developer, not the law. Our UK guide to selling before handover explains the NOC (no objection certificate) and typical thresholds.

Lost job, off-plan payments, Dubai (UK investors): what happens?

Losing your job does not, on its own, change the contract. The SPA and Article 11 still apply.

Example: a hypothetical buyer in Manchester misses an AED 50,000 instalment and strikes no deal within 30 days. The developer may then terminate, and the cost turns on the project's completion percentage, not the buyer's circumstances.

Notice period
30 days

Below 60% complete
Up to 25% kept
60% and above
Up to 40% kept
Refund of excess

For the tiers in detail, see the UK guide to the 25% and 40% rules. For a planned exit rather than a default, read about every way to cancel an off-plan contract.

Should I ask for proof of construction before paying the next instalment?

You can. The DLD FAQ says that before paying, an investor can ask the DLD-approved project consultant for a letter confirming the completion percentage. Payment plans are still set by your SPA.

What UK-side points matter when a payment is late?

Time zones and bank limits matter most. A deadline in a Dubai notice runs on UAE time.

How long do UK buyers have to pay after missing a Dubai off-plan instalment?

UK buyers who miss a Dubai off-plan instalment get 30 days from a written, dated notice served by the Dubai Land Department. The notice follows the developer reporting the default and the DLD verifying it. The DLD may mediate during that time, and any settlement is attached to the SPA as a signed addendum.

Can a Dubai developer take my unit straight away if I miss a payment?

A Dubai developer cannot simply take the unit the day a payment is missed. Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, requires notice to the DLD, a DLD notice to the buyer and a 30-day period. Only after that may the developer act under the completion-based tiers.

What can I do if I can't pay off-plan instalments from the UK?

A buyer in the UK who cannot pay Dubai off-plan instalments can ask the developer in writing for a revised schedule, ask the DLD to mediate, or explore a resale with the developer's NOC. Many developers require 30–40% paid before resale. Acting inside the 30-day notice period keeps the most options open.

Does losing my job let me cancel a Dubai off-plan purchase?

Losing a job does not by itself give a buyer the right to cancel a Dubai off-plan purchase. The SPA and Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, still apply. A buyer can negotiate with the developer, seek DLD mediation or pursue a resale.
