Short answer
- A booking deposit refund from a Dubai developer, for UK investors, turns on timing; once you are an off-plan buyer, the DLD FAQ says all amounts received from buyers go into the project's escrow account under Dubai Law No. 8 of 2007.
- An SPA must be registered in the Interim Property Register (Oqood) within 90 days of signing, and an unregistered sale is void under Article 3(1) of Law No. 13 of 2008.
- Before an SPA, refund terms for a reservation are whatever the developer put in writing; after an SPA, the contract and Dubai's termination rules take over.
- A deposit sent from a UK bank to Dubai falls outside the UK APP reimbursement scheme, which covers domestic payments only.
You reserved a unit, paid a booking amount, and now want out or are being told the money is gone. The first question: had you signed an SPA when you paid?
Can UK investors get a booking deposit refund from a Dubai developer?
Sometimes, and the route depends on timing. Before an SPA (sale and purchase agreement) is signed, the developer's written reservation terms decide it; after signing, the SPA and Dubai law decide it.
He offered to return my money in instalments paid in post-dated cheques…
An offer like that is a negotiation, not a refund. Before replying, establish three facts: whether an SPA was signed, whether it was registered, and which account received your money.
What changes once the SPA is signed?
The deposit becomes a buyer payment with legal rules attached. The escrow account is the bank account opened in the project's name under Dubai Law No. 8 of 2007, and the DLD FAQ says all amounts received from buyers of off-plan units are deposited there.
Oqood is the DLD's self-registration system for the Interim Property Register. The DLD says a signed SPA must be registered within 90 days, after which the buyer receives a provisional registration e-certificate by email.
| Before SPA | After SPA | |
|---|---|---|
| What governs a refund | Developer's written reservation terms | The SPA plus Dubai law |
| Escrow position | Not confirmed for pre-SPA payments | Buyer payments go to project escrow (DLD FAQ) |
| Registration | None | Oqood within 90 days of signing |
| If you walk away | Depends on the terms | Termination rules in Article 11 may apply |
If you signed and then stop paying, Dubai law sets what a developer may keep after the DLD notice process: up to 25% of the unit value below 60% project completion, and up to 40% from 60% (Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020). If construction has not started, or RERA cancels the project, everything paid must be refunded.
What if the booking amount is not refunded and there is no registration?
Treat a missing Oqood certificate as a serious question. Under Article 3(1) of Law No. 13 of 2008, a sale of an off-plan unit is void unless entered in the Interim Property Register, and Article 10 says a contract signed before the project is approved is null and void.
If the developer delays or refuses registration, the DLD FAQ says the investor can apply to its Real Estate Registration Assurance section with supporting documents. MIO Law Firm (June 2026) notes that non-registration does not automatically rescind the contract; remedies can include an order to register, a fee refund, damages or, where justified, cancellation.

Can my UK bank or a UK body recover the deposit?
Not through the usual consumer routes. The APP reimbursement scheme, which started on 7 October 2024, covers UK-to-UK Faster Payments and CHAPS with a £85,000 cap, so a deposit sent to Dubai sits outside it.
How should I document the claim from Britain?
Keep a dated trail in both time zones. Dubai is 4 hours ahead of the UK under GMT, which resumes on 25 October 2026, and 3 hours ahead during BST; note both times on calls and keep email timestamps.
Reservation refund evidence
Compare the developer's paperwork with the public record before your next letter. If the money went to an account that is not the project's escrow, see the UK guide to payments outside escrow.
