An off-plan dispute with a Dubai developer: where UK investors can take it

Off-plan dispute with developer in Dubai, for UK investors: what DLD settlement can and cannot do, and when the Dubai Courts or arbitration take over.

By HomeProof Research TeamUpdated 6 min readDubai law · every fact with a source

Short answer

  • In an off-plan dispute with a developer in Dubai, UK investors should know the DLD can attempt an amicable settlement, and a settlement it approves is binding, but the DLD FAQ says it cannot terminate a contract at the investor's request.
  • Termination or compensation claims go to the Dubai Courts, or to arbitration if your SPA contains an arbitration clause; Article 11(g) of Law No. 13 of 2008, as amended by Law No. 19 of 2020, preserves that right.
  • GOV.UK warns that Dubai cases can take many months and sometimes years.
  • The FCA does not regulate land investments, so the Financial Ombudsman Service and FSCS are not available for a Dubai off-plan purchase.

For a buyer in Britain the position is awkward: the contract, the regulator and the courts are all in the UAE, and the familiar British complaint routes do not apply.

Where does an off-plan dispute with a developer in Dubai go for UK investors?

It goes to Dubai bodies, in a set order of options. The DLD (Dubai Land Department) can try to broker a settlement; anything beyond a settlement, such as ending the contract or claiming money, belongs to the Dubai Courts or, if your SPA says so, an arbitrator.

…as investors from the UK, we have no right to apply UK law…

The quote captures a common shock. Your SPA, the sale and purchase agreement, is a Dubai contract, so Dubai law and Dubai forums apply to the dispute.

Should I try DLD amicable settlement first?

It is the lighter first step, with limits. The DLD may try to settle developer and buyer disputes, and a settlement it approves is binding (Executive Council Resolution No. 6 of 2010, Article 14, as reported by Khaleej Times).

The DLD FAQ is explicit that it cannot terminate a contract at the investor's request; for termination, the investor should go to the real estate court. Note too that the DLD e-service called "Dispute Lawsuit (for Amicable Settlement)" is aimed at rental issues, and lease complaints go to the Rental Disputes Center.

Can UK buyers sue a developer in Dubai?

Yes. A buyer may file a civil claim in the Dubai Courts, or go to arbitration where the SPA includes an arbitration clause.

According to Clyde & Co (July 2025), the Dubai Courts' Centre for Amicable Settlement of Disputes has exclusive first-step jurisdiction over claims up to AED 500,000, among others, under Law 18 of 2021 and Resolution 4 of 2025. The article does not spell out how this applies to real estate, so confirm the route with a UAE-qualified lawyer.

A lot of complainants come to the court without purchase contracts.
Abdul Qader Mousa Mohammad, Chief Justice of Dubai Real Estate Court · Gulf News, Jul 2019

The point from Dubai's real estate court still holds: bring the signed contract.

  1. Assemble the contract file

Signed SPA, Oqood registration certificate, payment receipts and bank confirmations, in date order.
  2. Pin down the public record

Save the project's status, completion percentage and escrow details from the DLD's Dubai REST app, with the date you checked.
  3. Write once, clearly

Send the developer a dated letter stating the issue and what you are asking for, and keep the delivery receipt.
  4. Instruct a UAE lawyer

Ask whether DLD settlement, the Centre for Amicable Settlement, court or arbitration fits your claim and SPA.

Can anyone in the UK take up my case?

Not in the way many buyers hope. The FCDO says embassies have no jurisdiction to become involved in private legal matters overseas, and cannot intervene in another country's processes or mediate on your behalf.

How do I run a Dubai case from the UK day to day?

Plan around the clock and the calendar. The UAE is 3 hours ahead of the UK during British Summer Time and 4 hours ahead under GMT, which returns on 25 October 2026, so a call at 10am in London reaches a Dubai lawyer by early afternoon.

Expect a long timeline. GOV.UK advises that Dubai cases can take many months, and on occasion years, and that buyers could consider approaching RERA.

Before a first meeting with a lawyer, pull the project's registry facts so the file is complete. If the developer has simply stopped replying, start with the UK guide on a developer who won't respond; if the dispute is about lateness, see compensation for a late handover, for UK investors. The global guide to developer disputes and the UK buyers' hub round out the picture.

What does DLD amicable settlement with a developer offer British buyers?
DLD amicable settlement gives British buyers a mediated route with a Dubai developer: the Dubai Land Department may try to settle the dispute, and a settlement it approves is binding. It cannot terminate the contract at the buyer's request; the DLD FAQ directs termination requests to the real estate court instead.
How do UK buyers sue a developer in Dubai?
UK buyers sue a developer in Dubai by filing a civil claim in the Dubai Courts, usually through a UAE-qualified lawyer, or by starting arbitration if the SPA contains an arbitration clause. Article 11(g) of Law No. 13 of 2008, as amended by Law No. 19 of 2020, keeps the buyer's right to courts or arbitration.
Can the Financial Ombudsman help with a Dubai off-plan dispute?
No. The FCA states that land investments are not regulated by it, and without FCA regulation buyers do not have access to the Financial Ombudsman Service or the Financial Services Compensation Scheme. A Dubai off-plan dispute is handled through Dubai bodies: DLD settlement, the Dubai Courts or arbitration.
Does the Rental Disputes Center handle off-plan purchase disputes?
No. The DLD FAQ says the Rental Disputes Center deals with lease-contract complaints, and the DLD's amicable-settlement e-service is aimed at rental issues. Off-plan purchase disputes with a Dubai developer go to DLD settlement, the Dubai Courts or arbitration under the SPA.
Will the British Embassy help in a dispute with a Dubai developer?
The British Embassy cannot take up a private dispute. FCDO guidance says it has no authority to become involved in private legal matters overseas or to mediate. It can point you to its list of English-speaking lawyers, which it describes as not a recommendation, with no liability for financial loss.
