Cancelled real estate project in Dubai goes to liquidation: a playbook from the US

Cancelled real estate project in Dubai in liquidation? From the US: how the special tribunal and escrow payouts work, and how to follow your claim.

Short answer

  • When a cancelled real estate project in Dubai goes into liquidation, buyers from the US deal with a Dubai-only process: the Special Tribunal for Liquidation of Cancelled Real Property Projects, set up by Decree No. 33 of 2020.
  • The tribunal's decisions are "final and incontestable" and are enforced by the Dubai Courts' Execution Court; other Dubai courts, including the DIFC Courts, cannot hear these disputes.
  • The DLD's liquidation section pays out escrow money "in full or proportionally", and the DLD calls the expected timeline indefinite.

Cancelled real estate project in Dubai: liquidation explained from the US

Liquidation is the track a cancelled or unfinished Dubai project takes when money must be collected and shared among buyers. From the US you cannot speed it up, but you can keep your claim complete and easy to verify.

  1. Confirm which track your project is on

    Cancelled, unfinished or in liquidation.
  2. Hire Dubai counsel

Start from the State Department's attorney list.
  3. Assemble a claim pack

    Every payment, matched to escrow.
  4. Follow the escrow distribution

    Full or proportional.
  5. Plan for a long timeline

    Set a review rhythm.

Step 1: Is my project in liquidation or just cancelled?

Cancellation and liquidation are related but separate stages. RERA, the Dubai Land Department's (DLD) regulator, cancels a project by a final, reasoned decision; the special tribunal handles unfinished, cancelled and liquidated projects and can direct escrow trustees.

The Dubai REST app shows whether a project is active, finished or cancelled. If you cannot log in from the US, check the project's public record, then ask your lawyer which stage applies.

Step 2: How do American buyers find a lawyer for the special tribunal?

Start with the US Embassy's list of local attorneys, then vet them yourself. The State Department says embassies "may not recommend a particular foreign attorney", cannot act as your agent and "do not provide legal advice to the public".

Ask any lawyer you shortlist how they will report to you across an 8-to-12-hour time gap.

Step 3: What goes into a liquidation claim pack?

A claim pack proves who you are, what you bought and what you paid. The DLD ties liquidation time to complete documents, so a tidy pack removes one source of delay.

Step 4: How does escrow liquidation in Dubai pay US investors?

The DLD's Real Estate Projects Liquidation Section distributes escrow funds "in full or proportionally", depending on what is available. Under Law No. 8 of 2007, the developer's creditors cannot seize escrow deposits. Escrow protects how your money is used; it does not ensure a full payout.

Step 5: How do I follow a claim that has no end date?

Set a review rhythm instead of waiting for news. Example: a monthly DLD status check, a quarterly lawyer update, and one folder for every reply, stamped in Dubai and US time.

Mind the US paperwork while you wait. IRS guidance on Form 8938 says foreign real estate held directly is not a specified foreign financial asset, but a UAE bank account may need to be reported. Ask a US tax adviser about FBAR and Form 8938 (general information only).

What if someone offers to speed up my liquidation payout?

Treat any offer to "fast-track" a liquidation payment for a fee as a warning sign. The process runs through the tribunal and the DLD. If you are asked to wire money abroad for that purpose, report it to the FBI's IC3 at ic3.gov and the FTC at ReportFraud.ftc.gov, and call your bank at once.

The SEC's Investor.gov checklist names requests to pay by "wire transfer abroad" as a red flag. For the tribunal in depth, open the liquidation pillar; the US-resident hub lists the US refund playbook for cancelled projects and disputes with a Dubai developer.

What is the special tribunal for cancelled projects in Dubai?
The Special Tribunal for Liquidation of Cancelled Real Property Projects is a Dubai judicial body created by Decree No. 33 of 2020. It handles unfinished, cancelled and liquidated projects, can direct escrow trustees, and issues final decisions enforced by the Dubai Courts' Execution Court. American buyers take part through a Dubai lawyer.
Can American buyers appeal a special tribunal decision?
American buyers cannot appeal a decision of Dubai's special tribunal for cancelled projects, because Decree No. 33 of 2020 makes its decisions final and incontestable. Other Dubai courts, including the DIFC Courts, cannot hear these disputes. A UAE-qualified lawyer can explain what can still be raised before a decision is issued.
How long does escrow liquidation in Dubai take for US investors?
Escrow liquidation in Dubai has no fixed duration for US investors or anyone else. The DLD FAQ calls the expected timeline indefinite and ties it to documents, amounts and eligible persons being complete. Historical 2008-era press reports describe court cases of two to four years.
Will I get everything back from a liquidated Dubai project?
A buyer in a liquidated Dubai project receives escrow money in full or proportionally, depending on what the account holds. The law requires a full refund when RERA cancels a project, but actual recovery depends on available escrow funds and on the developer paying any shortfall, which can take a long time.
