Paid the developer, not the escrow account, in Dubai: what to do now from the US

Paid the developer, not the escrow account, in Dubai from the US? Why it matters under Dubai Law 8 of 2007 and who to call: bank, developer, DLD, IC3.

Short answer

  • If you paid the developer, not the escrow account, in Dubai from the US, act on two tracks at once: ask your bank about a recall, and ask the developer in writing to move the money into the project escrow account.
  • Under Dubai Law No. 8 of 2007, Article 7, off-plan buyer payments go into an escrow account opened in the project's name; Article 9 keeps that account out of reach of the developer's creditors.
  • In June 2024, the director of RERA's Real Estate Control Department urged investors not to pay outside a project's escrow account.
  • Regulation E excludes Fedwire and similar wire systems, and a recall depends on the receiving bank's cooperation.
  • If fraud is suspected, the FBI's IC3 advises contacting the sending bank as soon as fraud is recognized.

Where the money sits decides who can reach it later. A payment in the project escrow account is ring-fenced by law; one in a general company or personal account is not.

Escrow money in Dubai can only be used for that project and cannot be seized by the developer's creditors, under Law No. 8 of 2007, Article 9(1). A payment outside escrow has neither feature, so the aim is to get it recorded in escrow, or returned.

Escrow vs. other accounts in Dubai

Use of fundsThat project only (Art. 9)Not restricted by the escrow law

  1. Call your US bank

    Ask about a recall today.
  2. Identify the recipient

Name and bank on the wire.
  3. Demand a transfer to escrow

    In writing, with a deadline.
  4. Escalate in Dubai

    DLD, then a lawyer.
  5. Report if it looks like fraud

    IC3 and the FTC.

Step 1: Call your US bank the same day

The IC3's 2022 annual report says to contact the originating financial institution as soon as fraud is recognized to request a recall or reversal. Speed matters more than certainty here.

Step 2: Identify exactly who received the money

Take the beneficiary name, bank and account number from your wire confirmation. Compare them with the escrow account shown in Dubai REST, which the DLD says displays the escrow account number for off-plan projects. See our escrow verification playbook.

Step 3: Ask in writing for the payment in escrow, or back

If the recipient is the developer, request written confirmation that the amount has been deposited into the project escrow account, with the escrow agent's reference. If the recipient is a broker or individual, ask for an immediate return.

Example: a hypothetical installment of AED 100,000, about $27,229, sent to a company's general account. Ask for that exact amount to be shown credited in escrow, and keep the reply.

Step 4: Escalate within Dubai

The DLD may try to settle developer–buyer disputes, but it cannot cancel a contract; claims go to the Dubai Courts or arbitration. Law No. 8 of 2007 has no stand-alone offence for receiving money outside escrow, but Article 16 sets jail and/or a fine of at least AED 100,000 for misappropriating money handed over for development. Our dispute route map covers each forum.

Step 5: Report in the US if this looks like fraud

The FTC says to tell your bank immediately and report at ReportFraud.ftc.gov. According to ic3.gov, complaints there can, in some cases, even help the FBI freeze stolen funds.

If the payment was cash, start with paid cash for off-plan in Dubai. The global guide to payments outside escrow and the collection of US guides have more, or look up a project's registry facts.

Payments outside escrow: questions from American buyers

What does a payment not in escrow mean for American buyers in Dubai?
A payment not in escrow means your money is outside the project account that Dubai Law No. 8 of 2007 ring-fences for construction. Escrow deposits cannot be seized by the developer's creditors and can only fund that project. American buyers should ask the developer to show the amount credited in escrow, or return it.
What should US investors do after a wrong-account off-plan payment?
After a wrong-account off-plan payment, US investors should call their bank the same day about a recall, identify the recipient from the wire confirmation, and ask in writing for the amount to be credited to the project escrow account. If fraud is suspected, report to the FBI's IC3 and the FTC.
Can my US bank reverse a wire sent to the wrong Dubai account?
A US bank can request a recall of an international wire, but cannot force one. Wise's documentation says recalls need the recipient's acceptance and the beneficiary bank's cooperation, and can take several weeks. Regulation E excludes Fedwire and similar wire transfer systems, so its error protections do not cover these transfers.
Is it a crime in Dubai for a developer to take money outside escrow?
Dubai Law No. 8 of 2007 has no specific offence for receiving money outside escrow in its English text. Article 16 does set jail and/or a fine of at least AED 100,000 for misappropriating money handed over for development or knowingly selling units in fraudulent projects. RERA has publicly urged buyers not to pay outside escrow.
