Paid the developer, not the escrow account, in Dubai: what to do now

Paid the developer, not the escrow account, in Dubai? Why it matters under Law 8 of 2007, how to confirm where the money went, and the steps to take now.

By HomeProof Research TeamUpdated 7 min readDubai law · every fact with a source

Short answer

  • If you paid the developer and not the escrow account in Dubai, the money may sit outside the protections of Law No. 8 of 2007, which sends off-plan buyer payments to a project-specific escrow account that the developer's creditors cannot seize.
  • In June 2024, after fining three developers AED 500,000 each, RERA's Real Estate Control Department urged investors not to make any payments outside a project's escrow account.
  • First, confirm where the money went: compare the account on your transfer with the escrow account number in the DLD's Dubai REST app, and ask the developer for written confirmation.
  • A recall of an international transfer is a request, not a reversal, and it needs the receiving bank's cooperation.
  • The DLD can try to settle a dispute but cannot cancel a contract; claims go to the Dubai Courts or arbitration.

Why does it matter if you paid the developer, not the escrow account, in Dubai?

It matters because Dubai's escrow rules protect money that is in the project's escrow account, and a payment to the developer's general account may not have reached it. Until you confirm otherwise, treat that payment as outside the ring-fence.

An escrow account in Dubai is a bank account opened in a project's name under Law No. 8 of 2007, run by a bank licensed by the UAE Central Bank and approved by RERA, the Dubai Land Department's (DLD) regulatory arm. It has three features a company account lacks:

  • One project only: under Article 9(1), the account is used only for that project, and deposits cannot be seized by the developer's creditors.
  • Limited withdrawals: the DLD FAQ says money goes out mainly to contractors, consultants and marketing, with marketing capped at 5% of total sales.
  • Buyer access: under Article 12, depositors may see their own accounting records and ask for copies.

How common is a payment not in escrow in Dubai?

No official figure exists for how many payments miss escrow, but the regulator's public warnings show it is a known problem. The clearest signal came in June 2024.

The director of RERA's Real Estate Control Department urged investors not to make any payments outside a project's escrow account. Reader letters show the buyer's side.

…there is no escrow account for the project.

That letter concerned a project outside Dubai, but the question is the same: was there an escrow account, and did the money reach it?

How to confirm whether your money is outside escrow

Compare three things: the account on your bank record, the escrow account shown in the DLD's systems, and what the developer confirms in writing. If all three match, the payment reached escrow.

  1. Find the account you paid

Pull the bank confirmation or SWIFT message for each payment. Note the beneficiary name, bank and account number exactly as they appear.
  2. Find the official escrow account

In the Dubai REST app, open Services, choose Project Status (Mashrooi) and search the project name. The DLD guide says it shows escrow account details alongside project and developer details.
  3. Compare line by line

Check the bank name and account number. A different bank, or a company name without the project name, is a reason to ask questions.
  4. Ask the developer in writing

Request a statement of account for your unit and written confirmation that each payment was deposited into the project escrow account, with dates.
  5. Ask the escrow bank for your records

Under Article 12 of Law No. 8 of 2007, depositors or their representatives may see their own accounting records and request copies.

For future payments, see how to verify the escrow account before any transfer.

Wrong account off-plan payment: what the law offers

Dubai law offers two tools when a wrong account off-plan payment cannot be resolved: civil claims and criminal penalties for misuse of development funds. Neither assures recovery.

Criminal side. Under Article 16 of Law No. 8 of 2007, a jail sentence and/or a fine of at least AED 100,000 apply to anyone who steals, misappropriates or forfeits money handed over for development, or who knowingly sells units in fraudulent projects. The English text has no separate offense of "receiving money outside escrow"; that conduct would be assessed under Article 16(4) or other laws.

Civil side. The DLD can attempt an amicable settlement but cannot terminate a contract; the DLD FAQ says that for termination "the investor ... should go to the real estate court." Claims go to the Dubai Courts, or to arbitration if the SPA provides for it. Read where an off-plan dispute actually goes for the stages, and bring the project's public registry record to that conversation.

Does escrow assure completion?

No. Hadef & Partners noted in 2010 that the escrow law does not guarantee completion, and buyers may become unsecured creditors once escrow funds run out. See what happens to buyer money when a project is canceled, or, if you paid in notes, the guide for buyers who paid cash at a sales office.

Buying from the UK, US, Canada or Australia?

Home-country bank protections rarely reach a payment to a UAE account. Each country guide explains what your bank and authorities can and cannot do.

What happens if I paid the developer and not the escrow account in Dubai?
If you paid a Dubai developer and not the escrow account, the money may sit outside the protections of Law No. 8 of 2007 until it is moved there. Ask the developer in writing to confirm whether and when the payment was deposited into the project escrow account, and request a statement of account showing the amount credited to your unit.
How do I know if my payment is not in escrow in Dubai?
To know whether a payment is not in escrow in Dubai, compare the beneficiary account on your bank record with the escrow account details shown in the Dubai REST app's Project Status (Mashrooi) service. Then ask the developer for written confirmation and, under Article 12 of Law No. 8 of 2007, request your accounting records from the escrow bank.
Can I recall a wrong account off-plan payment?
A recall of a wrong account off-plan payment is possible to request but may not succeed. Payment provider documentation says recalls can take several weeks, need the recipient's explicit acceptance, and depend on the beneficiary bank's cooperation. Contact your bank as soon as you notice the problem and keep a record of the request.
Is receiving money outside escrow a crime in Dubai?
Receiving money outside escrow is not a stand-alone offense in the English text of Dubai's Law No. 8 of 2007. Article 16 does set criminal penalties, including a fine of at least AED 100,000, for misappropriating money handed over for development or knowingly selling units in fraudulent projects, and outside-escrow conduct may be assessed under those provisions.
