Short answer
- If buyers in Australia paid a Dubai developer but not the escrow account, the money sits outside the protection that Law No. 8 of 2007 gives off-plan payments.
- Article 7 of that law requires off-plan buyer payments to be deposited in an escrow account opened in the project's name, and Article 9(1) keeps those deposits out of reach of the developer's creditors.
- The director of RERA's Real Estate Control Department has urged investors not to make any payments outside the project's escrow account.
- Article 16 sets jail and/or a fine of at least AED 100,000 for misappropriating money handed over for development; there is no separate offence named "receiving money outside escrow".
- For a transfer from Australia, call your bank at once: a SWIFT recall is a request that needs the receiving bank's cooperation.
Decide quickly which of three situations you are in; in one of them, the first hours matter most. Then find the escrow account the record shows.

Why does a payment not in escrow in Dubai matter for Australian buyers?
A payment not in escrow in Dubai matters because escrow is the legal channel that ties buyer money to the project. Australian buyers whose money missed it lose the rules on how that money may be used, and recovery becomes a matter of tracing and claims.
An escrow account is a project-specific account run by a bank approved by RERA and licensed by the UAE Central Bank. The DLD FAQ says withdrawals are generally limited to contractors, consultants and marketing, with marketing capped at 5% of total sales.
| Feature | Paid into escrow | Paid elsewhere |
|---|---|---|
| Use of money | Limited to project purposes (DLD FAQ) | No escrow rules apply |
| Developer's creditors | Cannot seize deposits (Art. 9(1)) | Not protected by Art. 9(1) |
| Your records | Right to see your accounting records (Art. 12) | Only what the payee gives you |
| If the project stalls | Escrow agent must act to complete or refund (Art. 15) | Not covered by Art. 15 |
Branch 1: the payment left your Australian bank recently
Call your bank before doing anything else and ask it to stop the transaction or start a recall. Wise's documentation notes that recalls are not guaranteed, need the recipient's explicit acceptance and can take several weeks; the outcome depends on the beneficiary bank.
Branch 2: the money went to the developer's own company account
Ask the developer in writing to move the amount into the project escrow account and to send confirmation showing the escrow account number. Compare that number with Dubai REST using our escrow verification guide for Australia.
Example: a hypothetical AED 100,000 instalment went to a developer's operating account. Your letter asks for the transfer to escrow within a set number of days, and for a receipt that names the escrow account.
He could have alerted me about the lack of an escrow account.
Branch 3: a wrong account off-plan payment from Australia to a broker or individual
If the account belongs to a broker, an agent personally or a name you do not recognise, treat it as possible fraud. Report on the Australian side straight away, then speak to a UAE-qualified lawyer. Article 16 of Law No. 8 of 2007 covers anyone who steals, misappropriates or forfeits money handed over for development.
If the developer will not confirm a transfer to escrow, the DLD can attempt settlement and claims go to the Dubai Courts; see where an off-plan dispute goes from Australia.
Paid the developer, not the escrow account, in Dubai: what buyers in Australia can do at home
Buyers in Australia can report, try to stop a transfer, and document, but no Australian scheme is known to reimburse an overseas payment.
- The UAE is 7 hours behind Sydney and Melbourne during AEDT (4 Oct 2026 to 4 Apr 2027) and 4 hours behind Perth all year
- Send written demands early in your afternoon so they land in Dubai's morning
- Keep bank confirmations showing the SWIFT details and receiving account

FAQ
What happens if I paid a Dubai developer but not the escrow account?
A payment to a Dubai developer outside the escrow account falls outside the protections of Law No. 8 of 2007, which requires off-plan buyer payments to go into a project escrow account. Ask the developer in writing to move the amount into escrow and confirm the account number, and compare it with the escrow details shown in Dubai REST.
Can my Australian bank recall a payment sent to the wrong Dubai account?
An Australian bank can request a recall of a payment sent to the wrong Dubai account, but a recall is a request, not a reversal. Payment provider documentation says recalls are not guaranteed, need the recipient's explicit acceptance and can take several weeks. Contact your bank as soon as you notice the problem.
Does the Scams Prevention Framework refund payments outside escrow in Dubai?
The Scams Prevention Framework should not be relied on to refund a payment made outside escrow in Dubai. It is not a mandatory reimbursement scheme, key bank obligations start no earlier than 31 March 2027, and the available sources do not address international transfers to overseas recipients. Report suspected scams to Scamwatch and your bank.
Is receiving money outside escrow a crime in Dubai?
Receiving money outside escrow is not a named stand-alone offence in the English text of Dubai's Law No. 8 of 2007. Article 16 sets jail and/or a fine of at least AED 100,000 for anyone who steals, misappropriates or forfeits money handed over for development, and such conduct would be assessed under that article or other laws.
