Short answer
- If you want to cancel an off-plan contract in Dubai from Australia, there are four realistic exits: resale, a negotiated deal, the buyer-default process, or a claim that the developer broke the contract.
- Walking away after you stop paying lets the developer retain up to a quarter of the unit value on a project below 60% built, rising to 40% from 60% upwards.
- RERA cancellation, or a project never started for reasons outside the developer's control, means every dirham paid must be returned.
- The Dubai Land Department (DLD) cannot end a contract on an investor's request.

Can you cancel an off-plan contract in Dubai from Australia?
Yes, though no route is free and none works by simple notice. The path decides how much money comes back.
Your SPA (sale and purchase agreement) is the signed contract with the developer; RERA is the DLD's regulatory arm.
| Route | Who decides | What it costs you |
|---|---|---|
| Resale before handover | Developer issues NOC | NOC fee, transfer fees, price risk |
| Negotiated settlement | You and the developer | Whatever both sign |
| Buyer default | Fixed in law | Up to 25% or 40% of unit value |
| Breach claim | Court or arbitrator | Fees, time, uncertain result |
| RERA cancellation | RERA | Full refund in law; escrow limits apply |
Branch 1: the instalments are no longer affordable
For Australia investors, the cheapest way to exit an off-plan purchase in Dubai is often a resale. The contract passes to a new buyer, so the default deductions never arise.
Assignment needs the developer's No Objection Certificate (NOC), per the DLD FAQ. Many SPAs set a minimum paid share, commonly 30–40%, before a NOC is issued; that is a contract term, not law. See selling before handover from Australia.
…ask for a refund of the amount I have already paid?
No buyer in sight? Talk before you miss a due date. The DLD can mediate once a default notice issues, and anything agreed becomes a signed addendum to the SPA.
Branch 2: payments stop and the developer terminates
Statute caps the developer's share, measured on the whole project's completion. The rules sit in Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020.
- Below 60% built
- up to 25%
- Of unit value, once work has begun
- 60–80% built
- up to 40%
- Of unit value
- Over 80% built
- 3 options
- Keep contract, auction, or retain up to 40%
- DLD notice period
- 30 days
- To pay or settle
Example: a hypothetical AED 2,000,000 unit, AED 800,000 paid, whole project 70% built. The developer may retain up to AED 800,000 (40%), so nothing is left over to return. Our 25% and 40% termination guide for Australian buyers runs more scenarios.
Branch 3: ending the SPA because the developer broke it
Buyers in Australia who want to terminate an SPA in Dubai for the developer's breach need a judge or arbitrator. The DLD's role stops at amicable settlement; its FAQ directs termination requests to the real estate court.
For serious delay, Afridi & Angell point to Executive Council Resolution 6 of 2010, Article 20, as the basis for a court application.
Branch 4: RERA has cancelled the project
Only this exit carries a full refund in law. It also applies where work never began for reasons beyond the developer's control and without its negligence. The 30% deduction once allowed for not-started projects was removed in 2020.
The Australian side of an exit
Money already sent abroad rarely comes back by itself. Per Wise, a SWIFT recall needs the recipient's acceptance and may fail.
Negotiate in writing and in Dubai's hours. Sydney sits 7 hours ahead until 4 April 2027; Perth 4 hours ahead all year. Ask for each offer by email with the UAE date shown.
