Short answer

  • Leaving a Dubai off-plan Sale and Purchase Agreement (SPA) depends on the contract, the developer's agreement, a court, or the default rules in Dubai law.
  • Selling or assigning before handover is possible only with a No Objection Certificate (NOC) from the developer, according to the DLD.
  • If you stop paying, Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, lets the developer terminate and keep up to 25% or 40% of the unit value, depending on how far the whole project is built.
  • If RERA cancels the project, or work never started for reasons outside the developer's control, all payments must be refunded.
  • The DLD cannot terminate a contract at your request; termination claims go to the real estate court.

To cancel an off-plan contract in Dubai, Canadian buyers have five realistic routes, and their costs differ by tens of percentage points of the unit value. This page sets them side by side, then gives a checklist for each phase. Dubai rules only; other emirates differ.

What are the ways to cancel an off-plan contract in Dubai for Canadian buyers?

There are five: resell with the developer's NOC, agree a mutual exit, ask a court to terminate, default and let Article 11 apply, or receive a refund because RERA cancelled the project. Which one is open to you depends on your SPA and the project's status.

Can you exit an off-plan purchase in Dubai from Canada by reselling?

Often, yes, if the developer consents. The DLD FAQ says assigning the unit or the deferred sale contract to a third party is possible only after the developer issues a No Objection Certificate.

Developers commonly require 30–40% of the price to be paid first; that is a contract term set by the developer, not a legal requirement. Law No. 13 of 2008, Article 7, bars developers from charging resale fees beyond DLD-approved admin costs. See selling before handover from Canada.

How do you terminate an SPA in Dubai as a buyer in Canada?

Through agreement or through the court. The DLD can mediate a settlement, and one it approves is binding, but its FAQ says it cannot terminate a contract at an investor's request; for that, "the investor ... should go to the real estate court."

A buyer may apply to court under Executive Council Resolution No. 6 of 2010, Article 20, according to Afridi & Angell. Article 11(g) keeps your right to go to court or arbitration even after the developer starts the default process.

What does stopping payment cost?

Stopping payment hands the decision to the developer. After the DLD serves a 30-day notice, the developer may terminate and keep a share of the unit value set by the whole project's completion, under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020.

Example: on a hypothetical AED 1,000,000 unit with AED 300,000 paid, in a project 50% complete, the developer could keep up to AED 250,000. Get the tier detail in the 25% and 40% rules explained and the notice process in what happens after a missed instalment.

What should Canadians weigh before leaving?

Weigh travel, tax and timing as well as the Dubai cost. Global Affairs Canada warns that UAE authorities may impose exit bans over unpaid debts and civil matters, and that bounced cheques can bring fines or jail.

Canada-side checklist

The CRA's T1135 applies where specified foreign property costs more than $100,000; personal-use property is excluded. This is general information, not tax advice.

Can a Canadian buyer cancel a Dubai off-plan contract without losing money?
A Canadian buyer can leave a Dubai off-plan contract without a deduction mainly where RERA cancels the project or work never started for reasons outside the developer's control; then all payments must be refunded. A resale with an NOC or a negotiated exit may also limit losses. Stopping payment usually costs the most.
How much can a Dubai developer keep if I stop paying?
A Dubai developer can keep up to 25% of the unit value if the whole project is below 60% complete and work has started, and up to 40% from 60% upward, under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020. A 30-day DLD notice comes first.
Will the DLD cancel my SPA if I ask?
No. The DLD's FAQ says it cannot terminate a contract at an investor's request. Its role is limited to amicable settlement between the buyer and developer, and a settlement it approves is binding. To terminate an SPA against the developer's wishes, a buyer goes to the real estate court or arbitration.
Do I need the developer's permission to resell my off-plan unit?
Yes. The DLD says assigning an off-plan unit or the sale contract to a third party is possible only after the developer issues a No Objection Certificate. Many developers require 30–40% of the price to be paid first, which is a contract term rather than a legal rule.
