Short answer

  • Cancel off-plan contract, Dubai, UK investors: there are five realistic routes: resell with the developer's NOC, negotiate a settlement, go to court for the developer's breach, stop paying and face termination, or receive a full refund if RERA cancels the project.
  • If a buyer defaults, a developer may keep up to 25% of the unit value below 60% project completion and up to 40% from 60% (Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020).
  • The DLD cannot terminate your contract for you; termination claims go to the Dubai Courts or arbitration.
  • A UK resident who sells at a gain may owe Capital Gains Tax, according to GOV.UK.

Can I cancel off-plan contract (Dubai, UK investors) at will?

Not simply by changing their mind. A signed SPA (sale and purchase agreement) registered in the Interim Property Register binds both sides, so leaving needs one of a few defined exits, each with a cost.

The Dubai Land Department (DLD) FAQ is clear on one point: the DLD cannot terminate a contract at the investor's request. Its role is limited to amicable settlement, and for termination the investor should go to the real estate court.

Exit off-plan purchase, Dubai (British buyers): what are the routes?

Five routes exist, and their costs differ sharply. The table compares them on Dubai rules.

Exit routes from a Dubai off-plan SPA
RouteWhat it needsTypical cost to you
Resale before handoverDeveloper NOC; often 30–40% paid first (developer policy)NOC fee, transfer costs, any price gap
Negotiated settlementDeveloper agreement; DLD may mediateWhatever you agree, signed as an SPA addendum
Court termination for developer breachProof of breach; claim in Dubai Courts or arbitrationLegal fees and time
Stop paying (buyer default)DLD notice, 30 days, then developer may terminateUp to 25% or 40% of unit value
RERA cancels the projectFinal reasoned RERA decisionFull refund due in law

Terminate SPA, Dubai buyer (UK buyers): how does the court route work?

Through a court or an arbitrator, on grounds the law recognises. Afridi & Angell notes that a buyer may apply to court under Executive Council Resolution No. 6 of 2010, and that RERA can cancel a project for serious delay.

Not every delay is enough: HAS Law (July 2026) says courts weigh the reasons for delay, force majeure, actual progress and the developer's conduct.

What does it cost to walk away by stopping payment?

It depends on how far the whole project has been built, not your unit. Under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020, a developer can terminate after DLD notice and 30 days, then keep a share of the unit value.

Up to 25% kept

Example: on a hypothetical AED 1,000,000 unit in a project 50% complete, the developer could keep up to AED 250,000, refunding any excess within one year of termination or 60 days of resale, whichever is earlier. The UK guide to the 25% and 40% tiers and the guide to a missed payment explain the process.

Are there UK tax or banking points before I exit?

Yes on tax; banking offers little help. This is general information, not tax advice.

Call Dubai lawyers in your morning: Dubai is 3 hours ahead of London in BST, 4 hours on GMT from 25 October 2026. The UK buyers' hub links every related guide, and you can look up the project's status on HomeProof before you decide.

Can British buyers exit an off-plan purchase in Dubai without losing money?

British buyers can exit a Dubai off-plan purchase without a statutory loss mainly when RERA cancels the project or work never started, since the law then requires a full refund. Other exits, such as resale, negotiated settlement or buyer default, usually carry costs, ranging from NOC fees to the developer keeping up to 40% of the unit value.

Can the DLD cancel my Dubai SPA if I ask?

The Dubai Land Department cannot cancel an SPA at the buyer's request. The DLD FAQ says its role is limited to amicable settlement, and an investor seeking termination should go to the real estate court. If the SPA has an arbitration clause, termination claims can go to arbitration instead.

How much can a Dubai developer keep if a UK investor stops paying?

A Dubai developer can keep up to 25% of the unit value if the whole project is below 60% complete, and up to 40% from 60% upwards, under Article 11 of Law No. 13 of 2008, as amended by Law No. 19 of 2020. If construction has not started or RERA cancels the project, everything paid must be refunded.

Do I pay UK tax if I sell my Dubai off-plan contract at a profit?

A UK resident who disposes of overseas property may have to pay Capital Gains Tax, according to GOV.UK, and relief may be available if the same gain is taxed twice. Whether an off-plan contract resale creates a taxable gain depends on your circumstances, so check with HMRC guidance or a UK tax adviser.
