Short answer
- Compensation for a delayed handover in Dubai, claimed from Australia, is not automatic: no Dubai statute fixes a payout for lateness.
- Your sale and purchase agreement (SPA) sets any entitlement; a Dubai court or arbitrator settles disputes.
- Extension clauses of 6 to 12 months are common, and lateness inside that window is usually not a breach.
- HAS Law Firm (2026) says a claim needs a breach, real loss and a causal connection between them.
- Rent, interest and travel paid in AUD can form part of the loss, if you hold receipts.

Compensation for delayed handover in Dubai from Australia: the short answer
Nothing is paid simply because the keys are late. For a Dubai project, any money for lateness flows from the SPA's own terms or from a ruling, never from an automatic statutory scale.
A lawyer in Khaleej Times (December 2024) cites Civil Transactions Law Article 246(1): contracts are performed according to their terms and in good faith.
Branch 1: still inside the extension window
An extension clause can turn a late date into an on-time one. Afridi & Angell report SPAs often allow 12 extra months; BSA puts the range at 6 to 12.
Meanwhile, log the projected date in Dubai REST, the Dubai Land Department (DLD) app; see comparing a changed handover date with your contract.
Branch 2: the SPA names a delay payment
A written delay clause is the simplest route. The task becomes applying that clause, not proving loss from scratch.
Quote the clause number and dates, and request the amount in writing. Date your letter in UAE time too: Sydney is 7 hours ahead until 4 April 2027.
Branch 3: no clause, so the off-plan delay penalty must be proven
For buyers in Australia without a delay clause, the outcome turns on evidence. HAS Law Firm (July 2026) says judges weigh the reasons for delay, force majeure, real progress and the developer's conduct.
…I had to pay rent for over a year due to the delay.
Australian costs can form part of the loss, from Brisbane rent to AUD loan interest.
Evidence an Australian buyer should gather
Example: AUD 2,000 a month in rent for 10 months past the extended date is AUD 20,000 to document; recoverability is for the court.
Where late handover compensation claims for a UAE property are heard
For Australia investors in a Dubai project, the forum is Dubai. The DLD may attempt conciliation under ECR 6/2010 Article 14, and a settlement it approves binds both sides.
- Automatic delay payout
- None
- SPA and courts decide
- Typical SPA extension
- 6–12 months
- Varies by contract
- Amicable Settlement Centre
- up to AED 500,000
- First-step jurisdiction
- Proof needed
- Breach, loss, link
- HAS Law Firm, 2026
The DLD cannot end a contract for you. Claims go to the Dubai Courts, or to arbitration where the SPA provides for it. For a severe delay, Afridi & Angell note a buyer may ask a court to terminate under ECR 6/2010 Article 20; compare every way out of an off-plan contract from Australia.
What Australia can do from home
Canberra cannot make a Dubai developer pay. DFAT consular staff cannot give legal advice or step into another country's legal matters, commercial disputes included.
Tax is separate. The ATO says residents must declare worldwide income; ask a registered tax adviser how a settlement is treated (general information, not tax advice).
