Short answer

  • Sell off-plan before handover, Dubai, from the UK? Yes: registered off-plan units may be sold, mortgaged or otherwise disposed of under Article 6 of Law No. 13 of 2008.
  • The DLD says assigning the unit or contract is possible only after the developer issues a No Objection Certificate (NOC).
  • Many developers require 30–40% of the price paid before they issue the NOC. That is a contract term, not law.
  • Developers may charge only DLD-approved administrative costs on resales; Khaleej Times (2022) put NOC fees at AED 1,000–5,000 plus VAT.
  • A UK resident who sells at a gain may owe Capital Gains Tax, according to GOV.UK.

Can I sell off-plan before handover (Dubai) from the UK?

Yes, if your unit is registered and the developer issues a NOC. Article 6 of Law No. 13 of 2008 allows registered off-plan units to be disposed of by sale, mortgage or any other legal disposition, and the Dubai Land Department (DLD) FAQ says assignment needs the developer's No Objection Certificate first.

Living in Britain does not bar a resale; it means managing paperwork and any tax across two systems.

Off-plan resale, Dubai rules, UK investors: which ones apply?

Three layers apply: the law, the developer's policy in your SPA, and the DLD's registration step. Only the first is fixed for everyone.

Gulf News reported in 2018 that developers began requiring about 30%, sometimes 40%, paid before resale. Check your SPA for the exact figure.

Assign off-plan contract, Dubai (British buyers): what are the steps?

By finding a buyer, obtaining the NOC and transferring the registration. The Oqood record (Dubai's Interim Property Register entry for your unit) has to move to the new buyer.

  1. Check your paid percentage

Compare what you have paid with the SPA's resale threshold.

  2. Confirm the project record

Look up the project in the Dubai REST app (foreign investors log in with UAE PASS or a title deed).

  3. Apply for the NOC

Ask the developer, in writing, for its resale requirements, NOC fee and any outstanding amounts.

  4. Register the transfer

The transfer is registered with the DLD. Transfer costs on off-plan resales are not set out on an official DLD page we could verify, so ask for a written breakdown.

When should I start the resale process?

Early, because each step depends on another party. The developer sets the NOC timetable, and the threshold may require further instalments first.

If you are selling because you can no longer pay, act before any default notice arrives; the UK guide to a missed payment explains the 30-day process. If the developer refuses the NOC, see what to do when a resale is blocked.

What are the UK tax and money points on a Dubai resale?

HMRC may be interested in any gain. This is general information, not tax advice.

Are resale buyers met at UK property shows?

Dubai developers do market in London. The London Property Show in April 2026 at ExCeL featured several UAE developers, and the DLD has partnered with London's Dubai Property Show since at least 2015. Under the DLD's ad-permit rules, only preliminary reservations, not sales, are allowed at exhibitions.

The global guide, selling off-plan before handover, covers Dubai rules in full; the UK buyers' hub and every exit route put resale in context. Before listing, check the project's registry record.

Can I sell a Dubai off-plan property from the UK without travelling?

Living in the UK does not stop a Dubai off-plan resale. Registered units can be sold under Article 6 of Law No. 13 of 2008, but the developer's NOC is required first. How the transfer is signed and registered depends on DLD procedures, so ask the developer and a UAE lawyer what can be done remotely.

How much do I need to have paid before reselling Dubai off-plan?

Many Dubai developers require 30–40% of the price to be paid before they issue a NOC for resale. This is developer policy written into the SPA, not a legal requirement. Gulf News reported the practice starting in the second half of 2017. Your own SPA sets the exact figure that applies to you.

What fees can a Dubai developer charge for an off-plan resale?

A Dubai developer may not charge fees on off-plan resales except administrative costs approved by the DLD, under Article 7 of Law No. 13 of 2008. Khaleej Times reported in 2022 that NOC fees ranged from AED 1,000 to 5,000 plus VAT, varying by developer. Ask for the full breakdown in writing.

Do UK investors pay Capital Gains Tax on a Dubai off-plan resale?

UK residents pay Capital Gains Tax when they dispose of overseas property, according to GOV.UK, and relief may be available if the same gain is taxed twice. Whether a particular off-plan resale creates a taxable gain depends on your circumstances, so check HMRC guidance or speak to a UK tax adviser.
